1. About the Website

(a) Welcome to cellregen.au (Website). The Website is for wellness (Services).

(b) The Website is operated by CellRegen Pty Ltd (ACN 689 764 270). Access to and use of the Website, or any of its associated Products or Services, is provided by Cell Regen Pty Ltd. Please read these terms and conditions (Terms) carefully. By using, browsing and/or reading the Website, this signifies that you have read, understood and agree to be bound by the Terms. If you do not agree with the Terms, you must cease usage of the Website, or any of Services, immediately.

(c) Cell Regen Pty Ltd reserves the right to review and change any of the Terms by updating this page at its sole discretion. When Cell Regen Pty Ltd updates the Terms, it will use reasonable endeavours to provide you with notice of updates to the Terms. Any changes to the Terms take immediate effect from the date of their publication. Before you continue, we recommend you keep a copy of the Terms for your records.

2. Acceptance of the Terms

You accept the Terms by remaining on the Website. You may also accept the Terms by clicking to accept or agree to the Terms where this option is made available to you by Cell Regen Pty Ltd in the user interface.

3. Registration to use the Services

(a) In order to access the Services, you must first register for an account through the Website (Account).

(b) As part of the registration process, or as part of your continued use of the Services, you may be required to provide personal information about yourself (such as identification or contact details), including:

  • (i) Email address
  • (ii) Telephone number
  • (iii) Password
  • (iv) Full Name

(c) You warrant that any information you give to Cell Regen Pty Ltd in the course of completing the registration process will always be accurate, correct and up to date.

(d) Once you have completed the registration process, you will be a registered member of the Website (Member) and agree to be bound by the Terms.

(e) You may not use the Services and may not accept the Terms if:

  • (i) you are not of legal age to form a binding contract with Cell Regen Pty Ltd; or
  • (ii) you are a person barred from receiving the Services under the laws of Australia or other countries including the country in which you are resident or from which you use the Services.

4. Your Obligations as a Member

(a) As a Member, you agree to comply with the following:

  • (i) you will use the Services only for purposes that are permitted by:
    • (A) the Terms; and
    • (B) any applicable law, regulation or generally accepted practices or guidelines in the relevant jurisdictions;
  • (ii) you have the sole responsibility for protecting the confidentiality of your password and/or email address. Use of your password by any other person may result in the immediate cancellation of the Services;
  • (iii) any use of your registration information by any other person, or third parties, is strictly prohibited. You agree to immediately notify Cell Regen Pty Ltd of any unauthorised use of your password or email address or any breach of security of which you have become aware;
  • (iv) access and use of the Website is limited, non-transferable and allows for the sole use of the Website by you for the purposes of Cell Regen Pty Ltd providing the Services;
  • (v) you will not use the Services or the Website in connection with any commercial endeavours except those that are specifically endorsed or approved by the management of Cell Regen Pty Ltd;
  • (vi) you will not use the Services or Website for any illegal and/or unauthorised use which includes collecting email addresses of Members by electronic or other means for the purpose of sending unsolicited email or unauthorised framing of or linking to the Website;
  • (vii) you agree that commercial advertisements, affiliate links, and other forms of solicitation may be removed from the Website without notice and may result in termination of the Services. Appropriate legal action will be taken by Cell Regen Pty Ltd for any illegal or unauthorised use of the Website; and
  • (viii) you acknowledge and agree that any automated use of the Website or its Services is prohibited.

5. Payment

(a) All payments made in the course of your use of the Services are made using Stripe, Apple Pay and Google Pay. In using the Website, the Services or when making any payment in relation to your use of the Services, you warrant that you have read, understood and agree to be bound by the Stripe, Apple Pay and Google Pay terms and conditions which are available on their website.

(b) You acknowledge and agree that where a request for the payment of the Services Fee is returned or denied, for whatever reason, by your financial institution or is unpaid by you for any other reason, then you are liable for any costs, including banking fees and charges, associated with the Services Fee.

(c) You agree and acknowledge that Cell Regen Pty Ltd can vary the Services Fee at any time.

6. Arrivals and Late Arrivals

  • (a) Please arrive 10 minutes prior to your scheduled appointment to complete check-in and prepare for your treatment. Arriving late may result in a reduction of your treatment time if subsequent appointments are scheduled immediately after yours.
  • (b) If a client arrives late, the scheduled booking duration cannot be altered, and fees will be charged based on the original booking time and price.
  • (c) It is not possible to reduce the length of the appointment at the time of check-in.
  • (d) Appointments that begin after the scheduled start time due to late arrival will end at the originally scheduled conclusion time.

7. Cancellation / No Show Policy

  • (a) We require at least 24 hours’ notice for appointment cancellations or rescheduling.
  • (b) Cancellations made with less than 24 hours’ notice will be subject to a cancellation fee.
  • • Late cancellations (less than 24 hours): 50% of appointment fee.
  • • No-shows: 100% of appointment fee.
  • • Cancellations within 12 hours of booking cannot be made online; please contact the clinic directly.
  • We understand emergencies happen and will accommodate where possible.

8. Promotional Terms and Conditions

  • (a) Promotional offers are available for a limited time and subject to availability.
  • (b) Promotions are not transferable, redeemable for cash, or to be used in conjunction with any other offer unless otherwise specified.
  • (c) Promotional offers are valid only for the period stated and limited to one use per customer unless specified.
  • (d) The wellness centre reserves the right to amend, suspend, or withdraw promotions at any time without notice.
  • (e) Cancellation or rescheduling involving a promotion is subject to the standard cancellation policy.
  • (f) Misuse or violation of promotional terms may result in cancellation or ineligibility for future promotions.

9. Refund Policy

(a) Cell Regen Pty Ltd will only provide a refund of the Services Fee if they are unable to continue to provide the Services or decide, at their discretion, that it is reasonable to do so.

(b) These Terms apply in addition to your rights under Australian Consumer Law.

11. Copyright and Intellectual Property

(a) The Website, Services, and all related materials are protected by copyright under Australian and international law. All rights are reserved by Cell Regen Pty Ltd or its contributors.

(b) All trademarks, service marks and trade names are owned or licensed by Cell Regen Pty Ltd, who grants you a non-exclusive, royalty-free, revocable licence to:

  • (i) use the Website pursuant to these Terms;
  • (ii) store content for personal use; and
  • (iii) print pages for personal, non-commercial use.

(c) You may not reproduce, republish, distribute or modify any content without written permission from Cell Regen Pty Ltd.

12. Privacy

Cell Regen Pty Ltd takes your privacy seriously. Any information provided through your use of the Website and/or Services is subject to our Privacy Policy, available on the Website.

13. General Disclaimer

(a) Nothing in the Terms limits or excludes rights guaranteed by Australian law, including under the Australian Consumer Law.

(b) Except as required by law, Cell Regen Pty Ltd is not liable for indirect or consequential damages arising from your use of the Website or Services.

(c) Use of the Website and Services is at your own risk. Everything is provided “as is” and “as available” without warranty or condition of any kind.

14. Limitation of Liability

(a) Cell Regen Pty Ltd’s total liability in connection with the Services or these Terms will not exceed the resupply of the Services.

(b) Cell Regen Pty Ltd and its affiliates will not be liable for any direct, indirect, incidental or consequential loss, including loss of profit, goodwill or business reputation.

15. Competitors

Competitors providing similar services for commercial gain are not permitted to access this Website. Any breach may result in legal action and recovery of losses.

16. Termination of Contract

(a) These Terms remain effective until terminated by either party.

(b) You may terminate by giving 14 days’ written notice and closing your account.

(c) Cell Regen Pty Ltd may terminate your access if you breach these Terms, if required by law, or if continuation is no longer commercially viable.

17. Indemnity

You agree to indemnify Cell Regen Pty Ltd, its affiliates and agents from any loss, damage, or claim arising out of your use of the Website or breach of these Terms.

18. Dispute Resolution

(a) Parties must attempt to resolve disputes through negotiation and mediation before initiating legal proceedings.

(b) Mediation will be held in Ballina, NSW, Australia. Costs are shared equally.

19. Venue and Jurisdiction

The Services are intended for Australian residents. Any disputes shall be resolved in the courts of New South Wales, Australia.

20. Governing Law

These Terms are governed by the laws of New South Wales, Australia.

21. Severance

If any part of these Terms is found to be invalid or unenforceable, that part will be severed and the remaining provisions will remain in full force.
